વ્યક્તિ વેચાણ કરાર આધારે દાવાવાળી જગ્યાના કબજામાં આવેલ હોય ત્યારે તે એડવર્સ પઝેશન અંગેનો દાવો કરી શકે નહી.

It is well settled that a person claiming to be in possession under the agreement to sell, his possession be permissive possession and he cannot be permitted to contend that his possession is adverse and he has perfected his title by way of adverse possession.- In view of the aforesaid position of law, the defendant, who came into possession of the suit land pursuant to the agreement to sell, cannot claim adverse possession (para-7.10)
